In Indian Judiciary there are 2 types of Custody Judicial and Police Custody, Judicial, The person arrested is in the Custody of the Magistrate (Judiciary) for investigation
people who are arrested by police are first put in police custody which is normally at police station which in temparary till person is taken to judicial megistrate, where on the megistrate after going through case decide whether he should be bailed out, extend his police custody by keeping in police remand, or transfer him to Judicial custody where he is not convicted yet as criminal but his trial is in progress, He is kept their till the court gives their final judgement , if his is found guilty he is sent to jail for the period he is punished less with time spent in judicial custody, or else he is free.
