Suspects never have to give statements, and it's in their best interest not to, unless they are actually innocent, in which case, they should provide their alibi to avoid charges being filed.
But, anyway, the answer would be yes, if someone comes forward as a witness, the charges could be refiled, until the statute of limitations has run out.
