Ok, I was looking at a friend's horse to possibly buy her. I took her for a couple of weeks to work with her and see if I liked her. She was originally asking $1000. I kept the horse for 2 weeks and told her that I didn't want to buy her because she was inappropriate for the person that was going to ride her. So she says "Well, why don't you keep her for a while and work with her and get her trained and ridden a little bit and I'll keep trying to sell her. If I do, I'll pay you for working with her." I said ok. Well, I have had this horse for almost 4 months and she occaisionally sends me text messages (never calls) and says, "how about $400 dollars for her" and every time she does that is a week that I'm already broke and can't give her money. But yet she has never paid for or bought any feed or hay, I have provided it all. She has never paid me for my time and training of the horse or any type of board. How much longer before she is considered abandoned or does the horse become mine. She's a double registered Paint Saddlebred and she has papers. What do I do??
You should talk to a lawyer or call up one of those free legal advice hotlines. What you should have done was have both of you sign a contract. Oral contracts/agreements don't stand up too well in court. If she has promised you to pay for the expenses of this animal then she should be held liable. I've never owned a horse, but I would think having one for 4 months would cost close to if not more than $1,000, no? Either way I think she has no leg to stand on. The horse is basically yours by now if she hasn't come up with any cash to help feed the animal. What she's done is considered abandonment already in my opinion, especially if she's saying she doesn't want or can't take the horse back.
best bet is today go out and talk to a lawyer.
Did you have a written contract? because it's rather hard to do anything with out one. . . if you have all those texts, save em, keep and take em to the lawyer with you.
a lawyer is going to be your best bet at this time. . . four months worth of bills that she hasnt paid is well over 1,000 dollars the organal asking price. . . so just go to a lawyer ask what you can do and then try to come to an agreement with the lady.. but make sure you go into talks with her knowing the laws and such or your gonna be at a loss compared to her. Then I would suggest calling her and telling her that your keeping it. Because technacally that is abandoned, and you have pretty much covered the expences towards her. So she is legally yours. Good Luck!
what's wrong with putting it to her just like you did. You fed, watered, trained, boarded etc. and remind her of the original deal and your refusal of purchase. She knows but tell her 4 mo. have past. Have $200 or 300 cash and offer it and you want the papers. If not be prepared to tell her to come and get her now. Take a loss but deal with it now. I have a feeling you got a good horse for cheap. If you can phone her or go over would be better.
if you don't want it,it's not yours just take it back anyway. if she is there and she says she doesn't want it get her to put it in writing there and then.

I would figure out the board that she should have paid after the first 2 weeks,or month, then add on your time for working her daily and send her a bill. I bet she says just keep the horse in return, problem solved but make sure you keep copies and get her to sign the papers over to you. I think the contact a lawyer advice is good. For a small fee, the lawyer can tell you what to do. I suspect you will get advice something like: send a certified letter outlining the charges that the horse has incurred, and place a deadline for payment on the letter. Make the letter state that if the balance is not paid in full by ..................., then you will be assuming ownership of the horse pursuant to statute ?????. You will have to look that up for your state. Most states have a law that covers unpaid board on horses. You will still probably have difficulty getting the papers with out a signed contract though.
On the other hand, if you want to get rid of the horse, you could take it back to her place whether she wants it or not. Its not your horse.
