  • You cannot file an annulment for that length of time. Most states will allow you you to file an annulment up to 2 years after your marriage.
    All you can do is file for divorce. You'll need to read up on your state laws and determine the reason for divorce, each state has different reasons to file.
    If you do not know where the spouse is then you can place a Notice of Publication in your local newspaper (contact your court house and they'll tell you what papers they'll accept). File this notice and let it run for 30 days. Then get proof of this ad, and return it to the courthouse. This is considered "serving the absent spouse".
    You can then complete the divorce paperwork, and wait for it to be finalized.


  • I'm not sure about the 12 years but I was able to get an annulment after about a year and a couple of months. My lawyer was able to state in the annulment that there was fraud in the marriage. So there are certain circumstances, you should definitely consult a lawyer. I though there was no chance because I was in the marriage for more than 6 months but it turned out that I was so you never know.

Your "wife" is a bigamist if the two of you have obtained a marriage license and been legally married before she's legally divorced from her first husband. If this is the case, your marriage is not legal/valid.
